1. Acceptance of Terms

By accessing and using Qvian Suite ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of Qvian Suite, operated by Qvian Private Limited ("we," "us," or "our"), a company registered in the Maldives.

2. Description of Service

Qvian Suite provides a comprehensive business management platform that includes:

  • Point of Sale (POS) system with multi-payment support
  • AI-powered inventory management and forecasting
  • Integrated accounting and financial management
  • Customer relationship management tools
  • Business intelligence and analytics
  • Workflow automation and process management
  • Multi-location business unit management
  • Enterprise security and compliance features
3. User Accounts and Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Keep your account credentials secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

3.2 Account Responsibilities

You are responsible for:

  • All activities that occur under your account
  • Maintaining the confidentiality of your password
  • Ensuring your account information is accurate and up-to-date
  • Complying with all applicable laws and regulations
4. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Transmit harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Use the Service for any illegal or unauthorized purpose
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems to access the Service without permission
  • Share account credentials with unauthorized users
5. Payments, Refunds & Cancellation

5.1 Subscription Plans

We offer various subscription plans with different features and pricing. Subscription details are available on our pricing page.

5.2 Transaction Currency

All subscription charges are billed in MVR (Maldivian Rufiyaa).

5.3 Payment Terms

  • All fees are billed in advance on a recurring basis
  • Payments are processed via BML Connect (Bank of Maldives) payment gateway
  • For recurring billing, a tokenized reference of your payment card is stored securely
  • We may change our pricing with 30 days' notice
  • Taxes are not included and will be added where applicable

5.4 Card Tokenization & Payment Security

When you add a payment card, the transaction is processed through BML Connect (Bank of Maldives payment gateway). We use card tokenization to handle recurring billing securely:

  • What is tokenization: After your initial payment, BML Connect generates a secure token — a unique reference that represents your card. This token is used for subsequent recurring charges.
  • What we store: We store only the token reference, the card brand (e.g. Visa, Mastercard), and a masked version of your card number (e.g. "****1234") for display purposes. We do not store your full card number, CVV, or PIN at any time.
  • What we do NOT store: Full card numbers, expiration dates, CVV/CVC codes, or any raw card details. All sensitive card data is held exclusively by BML Connect in their PCI DSS-compliant environment.
  • How tokens are used: When a recurring subscription charge is due, we send the token to BML Connect to process the payment. BML Connect handles the actual card charge — your card details never pass through our servers.

5.5 Your Rights Regarding Stored Payment Methods

You have full control over your stored payment methods at all times:

  • View saved cards: You can view all your stored payment cards (showing card brand and masked number) in your account settings under Subscription.
  • Add multiple cards: You may add multiple payment cards to your account. The most recently added card will be used for recurring charges.
  • Remove any card: You can remove any stored card at any time from your account settings. Removal deletes the token reference from our systems.
  • Remove all cards: If you remove your last stored card, auto-renewal will be automatically disabled and your subscription will continue until the end of the current billing period, after which it will not renew.
  • Re-add a card: If you wish to resume your subscription after removing all cards, you will be redirected to BML Connect to make a payment and store a new card token.
  • Data deletion: Upon account termination or at your request, all stored card tokens and associated masked card data will be permanently deleted from our systems.

5.6 Refund Policy

Once a subscription payment is processed, it is non-refundable. Your subscription remains active until the end of the current billing period. No prorated refunds are issued for partial billing periods.

5.7 Cancellation

  • You may cancel your subscription at any time from your account settings
  • Cancellation takes effect at the end of the current billing period — no prorated refunds
  • You will retain access to the Service until the end of the billing period
  • You can remove your stored payment card at any time

5.8 Failed Payments & Suspension

  • If a recurring charge fails, the system retries for up to 3 days before suspending the subscription
  • Suspended subscriptions can be reactivated by updating your payment method and paying the outstanding invoice

6. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

  • You retain ownership of your business data
  • We process your data to provide and improve our services
  • We implement appropriate security measures to protect your data
  • You are responsible for the accuracy and legality of data you upload
  • We may use anonymized data for analytics and service improvement
7. Intellectual Property Rights

7.1 Our Rights

The Service and its original content, features, and functionality are owned by Qvian Suite and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Rights

You retain ownership of any content you submit, post, or display on or through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content in connection with the Service.

7.3 License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your business purposes in accordance with these Terms.

8. Service Availability and Support

8.1 Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance and updates
  • Technical issues or system failures
  • Force majeure events
  • Third-party service disruptions

We provide customer support through various channels including email, chat, and documentation. Support availability may vary by subscription plan.

9. Disclaimers and Limitations

9.1 Service Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties regarding the accuracy or reliability of any information
  • Warranties that defects will be corrected

9.2 Limitation of Liability

In no event shall Qvian Suite be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

10. Indemnification

You agree to defend, indemnify, and hold harmless Qvian Suite and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit or transmit through the Service
11. Termination

11.1 Termination by You

You may terminate your account at any time by canceling your subscription and contacting us to delete your account.

11.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your account and data, though we may retain certain information as required by law or for legitimate business purposes.

12. Governing Law and Disputes
